Nairobi, 3 May 2024 – The Eastern and Southern African Trade and Development Bank Group (TDB Group) organized a five-day workshop on “Negotiation and Drafting of International Business Transactions” from 29 April – 3 May 2024 at TDB Tower, TDB Group’s Operations Hub in Nairobi, Kenya for public sector lawyers across its Member States.

TBD Group collaborated with New Perimeter, DLA Piper’s nonprofit affiliate focused on global pro bono, to offer the training.

The training delved into the processes and strategies of international business transactions using simulations. It focused on negotiating complex and inter-related agreements typically encountered in transactions between African countries and multi-national corporations related to natural resources. Topics covered included joint venture agreements, supply agreements, technology license agreements, issues related to political, social and economic context in which the agreements are negotiated, as well as business and financial aspects of such agreements.

This is the third training for public sector lawyers co-organized by TDB Group. The first two were organized in collaboration with the African Legal Support Facility (ALSF) on sovereign debt and infrastructure, and power purchase agreements and legal frameworks for energy infrastructure.

David Bamlango, TDB Group Vice President, Deputy MD and General Counsel  said, “At TDB Group, we are cognizant of the need of our Member States to strengthen the skills and knowledge of their legal professionals to support the financing and implementation of strategic impactful projects. We are very pleased to collaborate with organizations such as New Perimeter to deliver premium training and coaching to meet the needs of public sector lawyers from our Member States, so that together we can continue working to advance sustainable development in our region.”

“We are grateful for the close collaboration with TDB on this important initiative and appreciate the high level of engagement from the government lawyer participants” said Sara Andrews, Co-director of New Perimeter.

Jay Finkelstein, DLA Piper Counsel and Course Leader said, “it is wonderful to work with so many representatives of countries from throughout Africa to help them build the skill set that they need to achieve better negotiated outcomes in contracts that will impact their countries for many years in the future.   With the assistance of TDB in this training and their ability to arrange for multilingual translation, all participants were able to engage fully with the material to enable this training to be such a success.”

The training was attended by 46 participants from 23 countries including: Botswana, Burundi, Comoros, Djibouti, DR Congo, Egypt, Eswatini, Ethiopia, Ghana, Kenya, Madagascar, Malawi, Mauritius, Mozambique, Namibia, Rwanda, Senegal, Seychelles, South Sudan, Tanzania, Uganda, Zambia, and Zimbabwe.
